"The document provides for the creation of a registry of monitored individuals subject to expulsion"

 

The Federation Council approved a law introducing a new expulsion regime for migrants without legal grounds to stay in Russia. This regime imposes restrictions on their rights and freedoms, as well as control measures.

The document applies to foreign citizens and stateless persons who are in Russia without legal grounds, reports RIA Novosti. The law introduces restrictions on their rights, such as a ban on:

- Changing their place of residence or stay without permission from the Ministry of Internal Affairs of the Russian Federation (MVD RF);

- Leaving the region of residence;

- Driving vehicles;

- Acquiring property;

- Entering into marriage;

- Registering real estate in the cadastre;

- Opening bank accounts and conducting other banking operations, except for payments of mandatory fees and receiving cash up to 30,000 rubles per month;

- Participating in religious and public organizations.

A registry of monitored individuals will be created for these citizens, maintained by the MVD RF. Information from the registry will be available for free on the ministry's official website, and the foreign citizen will be considered notified of their inclusion in the registry from the moment the information is posted online.

The law grants the MVD RF the right to access information about the bank accounts of such citizens, enter their residential and other premises, and monitor them via geolocation. Foreigners subject to administrative expulsion will be placed in special facilities until the expulsion decision is enforced.

If a decision is made regarding the undesirability of a minor foreigner's stay, a similar decision will be made concerning their legal representative.

The law allows foreigners to cross the Russian Federation's state border with expired or technically defective documents, provided they can still establish identity.

Border control agencies will now monitor the entry, exit, and transit of foreign citizens and stateless persons through Russian territory. The period of temporary stay in Russia for foreigners entering under a visa-free regime will be reduced to 90 days within one year.

The law will come into effect 180 days after its official publication, with the provisions on reducing visa-free stay taking effect from January 1, 2025.
