Rossiyanam Mogut Razreshit Vnesudebnoe Bankrotstvo

"The corresponding initiative was put forward by the Ministry of Economic Development"

The Ministry of Economic Development of the Russian Federation proposed to increase the maximum debt threshold at which a person can initiate personal bankruptcy out of court through a multifunctional center, up to 1 million rubles.

Currently, a citizen can initiate personal bankruptcy if he has outstanding obligations in the amount of 50-500 thousand rubles. and in relation to him, the enforcement proceedings were terminated due to the lack of property and a new one was not initiated after the return of the enforcement document to the claimant.

The Ministry of Economic Development proposes to increase the total amount of debt allowed for the initiation of a simplified bankruptcy procedure to 1 million rubles. At the same time, the amount of monetary obligations will not have to go beyond 50-500 thousand rubles.

It is proposed to allow debtors to submit revised applications once, including adjusting the list of creditors. In this case, half a year begins to be counted again - from the moment the updated notice is published in the Unified Federal Register of Bankruptcy Information.

They may also be allowed to transfer, without the consent of the debtor, in respect of whom the enforcement proceedings have been completed, his personal data to federal, regional executive authorities and municipalities.

It should be noted that from September 1, 2020 to the end of June 2021, Russians tried 10,961 times to initiate extrajudicial personal bankruptcy, the procedure was initiated only in 37% of cases (4032).
