"Restrictions on the employment of migrants imposed by the authorities of the regions of the Russian Federation will become a legal basis for terminating an employment contract"
The State Duma of the Russian Federation approved in the first reading a bill that closes a contentious gap in labor legislation related to the dismissal of foreign workers.
Currently, regional authorities have the right to establish quotas and restrictions on the employment of migrants, and employers are obliged to comply with these rules — reducing staff, otherwise facing administrative liability. However, the regional acts themselves were not considered an official basis for terminating employment contracts, leaving businesses in a vulnerable position and at risk of lawsuits.
The new document amends the Labor Code of the Russian Federation and establishes the rule that restrictions introduced by the constituent entities of the Russian Federation can serve as a legal basis for terminating contracts with foreigners.
State Duma Speaker Vyacheslav Volodin reminded that since the beginning of 2024, 21 federal laws have already been adopted in the field of migration policy.
